Investigating Airplane Accidents
The most important part of an airplane crash or aviation accident case is the investigation. As pilots themselves, our firm's attorneys know what to look for when determining responsibility and liability in a plane crash:
- Pilot's experience — How much experience did the pilot have? How current was the pilot's flying experience? Was he or she certified as a student pilot, a private pilot, a commercial pilot, or an airline transport pilot?
- Weather conditions — Was the pilot aware of any bad weather conditions? Special training and instrument ratings are needed beyond basic licenses to fly in bad weather. Additional training and certification is needed to become a commercial pilot.
- Condition of airplane — When was the last inspection, and who was it done by? Were there any deferred items or open logbook write-ups that may have affected the aircraft? What was the status of the aircraft airworthiness certificate?
- Airport equipment — Was the airport controlled or uncontrolled? Was fire rescue available? Were taxiway and runway markings adequate? Was there adequate lighting and movement areas?
- Other factors — Were there any physiological factors involved, such as fatigue, medication use, or substance abuse? Were all FAA requirements met?
